Terms of Service

These Terms govern the provision of virtual staging, 3D visualization and related media services (the “Services”) by ResiScore Inc., an Ontario corporation operating as Truly Staged (“we”, “us”), to real estate professionals and businesses in Canada and the United States (“Client”, “you”). By placing an order you agree to these Terms. The Services are offered for business purposes only.

1. Orders and pricing

Prices are quoted and invoiced in Canadian dollars (CAD): $30 CAD per image for 1–11 images and $25 CAD per image for 12 or more images per project. Promotional codes (such as FIRST10) apply once per new client and cannot be combined. Applicable taxes are added where required.

2. 30% retainer and balance

• A retainer of 30% of the total project value is payable when the order is placed.
• The retainer becomes non-refundable once architectural 3D rendering has commenced on your images.
• The remaining 70% balance is due upon your approval of the watermarked proofs, and before final high-resolution files are released.
• Proofs are watermarked and may not be downloaded, copied, or published until the balance is paid.

3. Delivery and revisions

We target delivery of proofs within 48 hours of accepting usable photographs. Each order includes one free style revision requested within 7 days of proof delivery. Timelines may be extended for large projects, unusable source images, or events beyond our reasonable control.

4. Intellectual property and licence

We retain all rights in the staged imagery until the balance is paid in full. Upon full payment, we grant you a non-exclusive, perpetual, worldwide licence to use the final images to market the specific property, including on MLS systems, brokerage websites, print, and social media. You confirm that you own or are authorized to use the original photographs you provide and grant us a limited licence to process them to perform the Services. We may display anonymized work in our portfolio unless you opt out in writing.

5. Board compliance and invariance warranty

The Services are limited to digital cosmetic staging: adding movable furniture, rugs, art and décor. We warrant that we will not intentionally alter permanent fixtures, walls, windows, flooring, or exterior views. Final images include a “Virtually Staged” disclosure and suggested MLS remarks. You remain solely responsible for complying with the advertising rules of your real estate board, MLS, RECO, TRESA and any other applicable regulator, including disclosing that images are virtually staged.

6. Client obligations

You agree to provide accurate information, lawful content, and photographs free of personal information that is not necessary for the Services, and not to use the Services to misrepresent a property.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost commissions, or regulatory penalties arising from your use of the images.

8. Disclaimers

Except as expressly stated in these Terms, the Services are provided “as is”, and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent permitted by law.

9. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Ontario.
